Premarital Planning Services
Our objective is effectiveness. Our strategy is transparency.
We understand that premarital planning is a sensitive and often emotional practice area, but where other attorneys see confrontation and secrecy, we see opportunities for transparency and congenial solutions for our client’s individual circumstances. Understanding and compassion are especially critical when counseling clients who are considering marriage. Whether the marriage will be the first or a subsequent marriage for one or both of the participants, planning together in advance for the inevitability of death or the possibility of divorce can provide the couple with peace of mind that their wishes will be honored. With the creation of a Prenuptial, or Antenuptial, Agreement, the couple can determine in advance what property and rights each partner will retain in the event the marriage is terminated by divorce or the death of a partner. Our attorneys have the knowledge and experience to counsel persons making these exciting and important life decisions.
Timely action is a priority for our premarital planning lawyers. We recognize the importance of communication and disclosure and we possess the creativity and sensitivity as well as the necessary negotiation skills to design a premarital plan that is customized to the client and his or her goals. Experience Counts.
We understand the value of communication and teamwork. We want clients who are satisfied with not only the results, but also the manner in which we handle their legal affairs. In addition to negotiating the terms of and preparing a premarital agreement that will clearly outline the client’s wishes upon a marital termination due to either dissolution or his or her ultimate death, Smith and Condeni frequently assists clients with estate planning recommendations and implementations due to an impending or recently solemnized marriage. We apply the same principles when handling these matters as we do with the administration of decedents’ estates and trusts. At Smith and Condeni, we focus on our clients’ needs and the couple’s wishes in order to effectively design a premarital plan that suits the individual client. In addition to these components, we also focus on:
- Using proven strategies to address asset distribution in the event of a divorce or similar premature end to the planned marriage;
- Implementing comprehensive approaches that transfer family assets at death as the client and his or her prospective spouse intended; and
- Utilizing the applicable law to minimize conflicts and obtain anticipated results on the occurrence of an anticipated event.
In order to meet the high standards that we set for ourselves, we take a multi-faceted approach to the premarital planning process. The head of our department is a specialist in estate planning, probate and trust law, one of an elite group of attorneys certified by the Ohio State Bar Association. All of our attorneys concentrate their areas of practice within related estate and trust planning fields.
