Whether the marriage will be the first or a subsequent marriage for one or both of the participants, planning together in advance for the inevitability of death or the possibility of divorce can provide the couple with peace of mind that their wishes will be honored. With the creation of a Prenuptial, or Antenuptial, Agreement, the couple can determine in advance what property and rights each partner will retain in the event the marriage is terminated by divorce or the death of a partner. We apply the same principles when handling these matters as we do with the administration of decedents’ estates and trusts. At Smith and Condeni, we focus on our clients’ needs and the couple’s wishes in order to effectively design a premarital plan that suits the individual client. - Using proven strategies to address asset distribution in the event of a divorce or similar premature end to the planned marriage;
