Clients have a number of issues that arise periodically regarding real estate that require the legal assistance of an attorney. The buying and selling of real estate is the most common. Some other real estate matters include, boundary disputes, lot splits, the sale of real estate from an estate, landlord-tenant issues, and eviction actions.

Businesses also have issues that involve real estate. For example, business owners are often faced with the dilemma of deciding whether to purchase their office or warehouse, or rent it from another entity. We work with the client's accountant and other business advisors to provide guidance and consultation on determining which approach is best for them. We believe that a team approach with the client's professional advisors working together ultimately provides the greatest benefit to the client, especially when real property is involved.

Also, because of the potential for liability, we provide advice, consultation and when requested, assistance to the client in how to properly title real estate. This is very important to protect the owner's personal assets and limit their liability for potential lawsuits that may arise simply due to ownership of the land and real estate. Currently, environmental cleanup for land that has been contaminated is a very important issue. The cost to clean up contaminated land can be very expensive. When business clients acquire real estate, we provide consultation and a plan to limit their liability for potential unknown prior contaminations, which often includes taking ownership of the real estate in the form of a corporation or a limited liability company.

Other matters that arise involving real estate include disputes with general or subcontractors for the original construction of, or repairs or additions made to homes or commercial buildings. Sometimes these matters involve defective products or workmanship that need to be corrected. It is quite often that these disputes cannot be resolved until legal counsel are retained to address the issues and protect the injured party.
